By accessing or using FloraWhisp at florawhisp.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

FloraWhisp is an AI-powered botanical assistant that helps users identify plants, diagnose plant health issues, and receive care advice. The service is powered by Anthropic's Claude AI model. FloraWhisp is provided for informational and educational purposes only.

FloraWhisp is not a substitute for professional advice. Plant identification and health information provided by the AI may be inaccurate or incomplete. Do not rely solely on FloraWhisp for decisions involving:

• Plant toxicity or safety for humans and animals
• Edibility or consumption of any plant or fungi
• Agricultural or commercial growing decisions
• Any situation where misidentification could cause harm

Always consult a qualified botanist, horticulturist, or other professional for critical plant matters.

You agree not to use FloraWhisp to:

• Upload images that contain personal or sensitive information unrelated to plants
• Attempt to circumvent, probe, or exploit the AI system
• Generate harmful, abusive, or illegal content
• Violate any applicable laws or regulations
• Use the service in any way that violates Anthropic's Usage Policy

The FloraWhisp name, logo, interface design, and original content are owned by the service operator. AI-generated responses are produced by Anthropic's Claude model; ownership of such outputs is subject to Anthropic's terms.

By uploading photos, you represent that you own or have the right to share those images, and you grant FloraWhisp a limited, temporary license to process them solely to provide the service.

FloraWhisp is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated information will be accurate or complete.

To the maximum extent permitted by applicable law, the FloraWhisp operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim (which, for a free service, is zero).

FloraWhisp relies on third-party services including Anthropic (AI processing) and Vercel (hosting). Your use of FloraWhisp is also subject to their respective terms and policies. We are not responsible for the practices of these third parties.

Your use of FloraWhisp is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to modify, suspend, or discontinue FloraWhisp at any time without notice. We may also update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the service after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.
